EXECUTIVE SESSION <br /> <br />Susan Griffiths, City Attorney, stated that the first request for <br />an Executive Session, requested by the Water Attorney, involved <br />litigation. <br /> <br />Mike Schimmin, Water Attorney, stated that the subject matter was <br />for three (3) specific items: <br /> <br />1.) Relates to a water Court case that is set for trial <br /> beginning next week. It's an application by the City of <br /> Lafayette to change certain water rights and apply for a <br /> plan for augmentation and exchange rights in case No. 90- <br /> CW-108. <br />2.) A case involving an application for water rights by the <br /> City of Boulder in case No. 90-CW-193 that is set for <br /> trial March 15. <br />3.) Relates to a request from Council in last week's Work <br /> Session concerning guidance about what kinds of <br /> information they receive from us (water attorney) is <br /> confidential, compared to what is not. <br /> <br />Howard stated that the second request for Executive Session was on <br />a matter for the acquisition of real property. <br /> <br />Maj-Lis Kemper, City Clerk read the required Executive Session <br />statement (SEE ATTACHED). <br /> <br />Davidson requested that Tom Phare, Public Works Director, attend <br />both Executive Sessions. <br /> <br />Lathrop moved that Council go into Executive Session to discuss <br />water matters concerning strategy and acquisition of property <br />concerning strategy. Seconded by Howard. All in favor. <br /> <br />RETURNED FROM EXECUTIVE SESSION <br /> <br />Tom Phare, Public Works Director, stated that the items that the <br />City Water Attorney requested Executive Session for litigation were <br />regarding case No. 90-CW-108, City of Lafayette, and case No. 90- <br />CW-193, City of Boulder. He stated that there is no Council action <br />regarding that matter. <br /> <br />Howard stated that in the Executive Session they discussed real <br />property acquisition as a function of acquiring parts or all of the <br />Lastoka property and the legal rights thereto. He explained that <br />there was one (1) Council action. He moved that the Council submit <br />questions to staff and for staff to answer their questions by the <br />next Council meeting.
