SUBJECT: A RESOLUTION EXTENDING THE SUSPENSION OF ORDINANCE NO. 1534, <br />SUBSECTION 3.20.412 ELECTRONIC DATABASE; RETAILER HELD <br />HARMLESS PAGE 2 OF 2 <br />DATE: SEPTEMBER 15, 2015 <br />The City has not been able to provide the required data file and, therefore, has been <br />unable to verify the accuracy of the provider's address data files. <br />Subsequently, in 2013, City Council approved Resolution No. 48, Series 2013 which <br />suspended Ordinance No. 1534, Section 3.20.412 of the Louisville Municipal Code for <br />an additional 24 months, which period will expire September 16, 2015. <br />At this time, the City has started work to develop and utilize its own address database, <br />or the ability to provide the electronic data files required by the State - certified database <br />providers, as part of the City -wide Enterprise Resource Planning system (ERP) <br />implementation, and Finance staff recommends a further extension of the suspension of <br />Ordinance No. 1534, Section 3.20.412 of the Louisville Municipal Code for an additional <br />period of 24 months. <br />FISCAL IMPACT: <br />If the described section of the ordinance is not suspended, the City will not be able to <br />collect sales taxes paid to the wrong jurisdiction from the taxpayers which utilize the <br />database due to the hold - harmless provisions of the ordinance. <br />RECOMMENDATION: <br />City Finance staff recommends City Council approve the suspension of Subsection <br />3.20.412 of the Louisville Municipal Code for an additional 24 months. <br />ATTACHMENT(S): <br />Proposed Resolution No. _, Series 2015. <br />CITY COUNCIL COMMUNICATION <br />
