by-laws have to conform to that, and <br />the Board would not have the power <br />to amend the by-laws in a fashion <br />inconsistent with the City <br />Ordinance. The only timing issue <br />that I see in the Code is the <br />appointment to the membership of the <br />Board. I don't know if that is <br />going to occur tonight. If it is, <br />we have a current ordinance which <br />talks about five (5) and two (2). <br />We have a proposed ordinance that <br />talks about six (6) members. At the <br />last meeting you considered the by- <br />laws and approved them subject to <br />the condition that the residency <br />requirement appear in the by-laws, <br />because it didn't appear in the <br />draft that you had last time. What <br />you have tonight is a copy of the <br />by-laws with that provision and <br />signed by the former Board of <br />Adjustment. You've already acted on <br />that. What you have tonight is only <br />the ordinance itself doing the three <br />(3) things that the title says. The <br />current City Ordinance in Section <br />17.48.060 does require the vote of <br />four (4) members of the Board of <br />Adjustment to approve variances and <br />to overturn any decisions made by <br />the zoning administrator. All other <br />matters require a majority vote of <br />the members present at the Board of <br />Adjustment. If you want to change <br />that tonight, we'll have to amend <br />Section 17.48.060 onto this <br />ordinance. Going to an 80% <br />requirement still is an amendment to <br />17.48.060, because the ordinance now <br />says four (4) members. <br /> <br />Mayer moved that Council approve Ordinance No. 1096, Series 1993, <br />an ordinance amending Chapter 17.48 of the Louisville Municipal <br />Code. Seconded by Sisk. Roll call was taken.
