C Shall otherwise constitute or be known or declared a <br /> nuisance by state statutes or the ordinances of the City, or <br /> D Pollutes or contaminates any surface or subsurface <br /> waters, or <br /> E Any activity, operation or condition which, after being <br /> ordered abated, corrected or discontinued by a lawful order of any <br /> department or officer of the City, continues to be conducted or <br /> continues to exist in violation of any statute or this Code or in <br /> violation of any regulation of the City, county, or the state <br /> Occupant means and includes any person who occupies the whole <br /> or part of a building, premises, or land, whether alone or with others <br /> Owner or property owner means any person leasing, owning, <br /> occupying, having the right to possession and/or control of any property <br /> located within the City boundaries <br /> Person means any individual, corporation, partnership, association, <br /> organization or other entity owning, occupying, keeping, leasing or having <br /> control of real property or any improvements thereon located within the <br /> City boundaries <br /> Public place means any place commonly or usually open to the <br /> general public or which is accessible to members of the general public <br /> Section 8.01.030. Nuisances prohibited. <br /> A. It shall be unlawful for any person, owner, agent, or <br /> occupant of, or who has control of, any property within the City to <br /> 1 Do, aid, abet or permit any activity or condition which <br /> creates or constitutes a nuisance, or fails to act where such failure <br /> causes or continues a nuisance, or <br /> 2 Fail, neglect, or refuse to comply with any lawful order <br /> made by the code enforcement officer or to fail to abate any <br /> nuisance within the time stated in a notice duly served upon such <br /> person <br /> B A failure to abate any nuisance shall be deemed a separate <br /> offense for every period of forty eight (48) hours after due notice is given <br /> to abate the same pursuant to section 8 01 050 <br /> Section 8.01.040.
