It is also not <br />intended to prevent Louisville or Boulder County from <br />amending any of their drainage regulations. <br /> <br />Do we have to go to Boulder County <br />or Lafayette to get approval, if we <br />want to change our drainage plans? <br /> <br />Not in my mind. Under the <br />regulations, we are required to give <br />them a notice of amendments to the <br />regulation. In my view, if after <br />those amendments are adopted no <br />action is taken by either Boulder <br />County or Lafayette to challenge <br />those regulations in some manner, <br />then in my mind they're waiving <br />their ability to do that. Should <br />they challenge them, it would be <br />pursuant to the provisions of the <br />agreement. One of the provisions of <br />the agreement says that any dispute <br />between the parties, as to the <br />meaning or application of this <br />agreement, must be submitted to the <br />review committee composed of two (2) <br />representatives of each of the <br />parties, with them selecting a <br />seventh member. That process must <br />be followed prior to anyone <br />initiating any litigation. <br /> <br />Would it not be fair to say that the <br />first paragraph in the drainage <br />reflects really the intent of the <br />IGA that was adopted in 1984-857 <br /> <br />I don't know that that agreement <br />really addressed drainage issues, so <br />I could not say that that was the <br />case. <br /> <br />Howard: <br /> <br />Griffiths: <br /> <br />How does this agreement affect <br />future Council's ability to alter or <br />regulate their own drainage? <br /> <br />There is no approval required. <br />Louisville adopts its amendments to <br />its drainage regulations.
