Wood:

With regard to the fence, that's
correct.

Howard:

And no substantial waiving of those
requirements?

Wood:

That's correct. The administrative
amendment did not amend the
construction design of the fence.
It only amended the application in
terms of the design of the fence.
The applicant had wanted to remove
the solid barrier, so that people
could see their model homes from
Dillon Road and not be blocked by
the 6 ft. solid stucco fence.

Lathrop:

There are a number of comments in
here that disturb me about the
flooding on the project, or the
potential for flooding, or apparent
flooding, or fear of flooding. If
that's the case, then the drainage
studies that are done with all
PUD's, certified by an engineer, are
in error someplace. If in fact
that's the case, then I would like
to know where the error is and why
it wasn't picked up on.

Davidson remarked that Tom Phare, Public Works Director, would soon
arrive at the meeting and Lathrop's concerns would be addressed at
that time.

Davidson called for the applicant's presentation.

Doug Davis, CFO, Club Homes Development Corporation, 400 South
McCaslin Boulevard, Suite 205, Louisville, Colorado, wanted to go
over the terms of an agreement that has been reached by 18 out of
19 of the homeowners currently residing in the PUD Club Homes at
Coal Creek and to introduce all of the technicians and the research
that has been involved in this project. He stated that the Club
Homes Memorandum of Agreement (SEE ATTACHED) Council had before
them is a supplement to the basic issues of the PUD amendment. He
stated that they are requesting that the papers be eliminated, that
the mailboxes stay on the street and not located by the gazebo in
Phase I, as negotiated with Louisville's Postal Department, the
backyard gates that were recommended and originally discussed with
PSCo, U.S. West, and the cable company has been deleted through
more conversations with the parties involved, since the Planning
Commission meeting. The fencing issue is resolved. The bike path
escrow that was placed in escrow in 1991, which they paid

9
