03489479 12/08/2015 10:53 AM <br />RF: $21.00 DF: $0.00 Page: 1 of 3 <br />Electronically recorded In Boulder County Colorado Recorded as recelved <br />ORDINANCE NO. 1708 <br />SERIES 2015 <br />AN ORDINANCE APPROVING THE VACATION OF A 25 -FOOT WIDE EMERGENCY <br />ACCESS EASEMENT WITHIN LOT 1, BLOCK 2, OF THE PARK AT CTC <br />WHEREAS, by the plat of The Park at CTC, recorded in the Office of the Boulder <br />County Clerk and Recorder on March 31, 1998 at Reception No. 1876736, there was <br />dedicated to the City a 25 foot emergency access easement on Lot 1, Block 2, in the <br />location further described in Exhibit A attached hereto and incorporated herein by this <br />reference ("the 25 foot Easement"); and <br />WHEREAS, the Tebo Partnership, which owns Lot 1, Block 2 and intends to <br />develop the lot, has requested vacation of the 25 foot Easement; and <br />WHEREAS, the City Council finds and determines that the 25 foot Easement for <br />which vacation is requested is not and will not be needed for any public purposes and will <br />not be needed for any City emergency access; and <br />WHEREAS, the City Council finds and determines that the 25 foot Easement for <br />which vacation is requested is not being used or held for park purposes or for any other <br />governmental purposes; and <br />WHEREAS, the City Council desires to approve the application and vacate the <br />City's interests in the 25 foot Easement for which vacation is requested; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby approves the vacation of that certain 25 -foot wide <br />emergency access easement located on Lot 1, Block 2, The Park at CTC, which <br />easement herein vacated is in the location further described in Exhibit A attached hereto <br />and incorporated herein by this reference ("the 25 foot Easement"). <br />Section 2. No other easements per the plat of The Park at CTC shall be deemed <br />altered or amended by virtue of this ordinance. <br />Section 3. All other ordinances or portions thereof inconsistent or in conflict with <br />this ordinance or, any portion hereof are repealed to the extent of such inconsistency or <br />conflict. <br />Section 4. The Mayor and City Manager, or either of them, is authorized to <br />execute such additional documents as may be necessary to evidence the vacation of the <br />25 foot Easement herein vacated, including but not execution of quit claim deeds. All <br />action heretofore taken in furtherance of the vacation of such 25 foot Easement are hereby <br />ratified and confirmed. <br />Ordinance No, 1708, Series 2015 <br />Page 1 of 2 <br />
