on some sort of license agreement, so if Louisville needed that
space, they'd have to move their fences. In addition, he wanted
the City to look, in terms of long term, whether it makes sense to
vacate the extra 10 ft. of right-of-way width on this street. The
street coming into it is 60 ft. The actual street itself is 60 ft.
There is a traffic problem there already. He didn't feel that the
City would have any reason why they would ever expand that street
or use a space as limited as 10 ft., in addition to the right-of-
way that it has.

Wilbert G. Zurliene, 807 West Mahogany Circle, Louisville,
Colorado, stated that he hasn't put any fence posts in, but if they
are permitted to put their fences in at 5 ft., 4 1/2 ft. or some
agreeable location, it would improve the entire area. He stated
that all of the houses that are subject to that situation are all
sitting in abeyance, trying to figure out what they can or cannot
do. He stated that, if he puts his fence where the line is now,
you'll be talking almost 10 ft. of area. Who maintains it? He
stated that the City says they will, but I've been cutting the
weeds right now to keep them down. The neighbor across the street,
who was out of town, signed the letter in agreement with it and he
asked Council's support in this, also.

Davidson called for Council comments and questions.

Lathrop:

I opposed the previous request for a
different set of circumstances than
you all are asking for. I went back
out and looked again at the
situation and I looked at several
other parts of town trying to find
something that was in the
neighborhood of 4 - 5 ft. from the
sidewalk. I found quite a few.
Four to five feet from the edge of
the concrete is substantially
different than 2 ft. in what I would
consider safety factors for kids
with bicycles, etc. I think your
request for your circumstance for 4
1/2 ft. from the edge of the
concrete is reasonable. I did
notice that Ms. Stein signed the
letter. I would assume that she
also would agree to that distance.

Osgood:

I know that she is agreeable with
that. As a matter of fact, she has
removed the posts that were a
problem before and has, basically,
moved back one fence section, which
would be about 5 ft. back.

3
