Council, and the City Clerk. She stated that tonight, with the <br />absence of the City Clerk, the Deputy City Clerk will be acting as <br />a member of the Title Board. The Council had been requested to <br />move the title setting up to an earlier date, specifically, at this <br />meeting. Hence, this special City Council meeting was called to <br />consider that request. She explained that if the Council approves <br />an amendment to Resolution No. 26 to replace July 6 as the title <br />setting date, with tonight's date of June 29, then the Council <br />could proceed to set the title for the ballot measure. She stated <br />that the first action at tonight's meeting was to consider whether <br />to move the date from July 6 to June 29, this meeting. A notice <br />was published in the Louisville Times, specifically notifying <br />everyone that the Council would be considering a change to tonight <br />in the date for setting the ballot title. <br /> <br />Sisk: <br /> <br />In the information that we have, the <br />indication is that the title has to <br />be considered at a regularly <br />scheduled meeting of the Governing <br />Board. What is your legal opinion <br />as to our meeting tonight? Is this <br />a regularly scheduled meeting? <br /> <br />Griffiths: <br /> <br />Arguably, it is. No one quite <br />knows. The wording appears in <br />Senate Bill 93-135, I believe. The <br />language has not been interpreted, <br />because the bill was just enacted <br />this session of the General <br />Assembly. I think the safest <br />approach is to set the title at a <br />regularly scheduled Council meeting, <br />July 6. However, if the Council <br />would like to take the action <br />tonight, it seems to me that an <br />argument could be made that it is <br />scheduled, according to the regular <br />procedures of the City Council for <br />scheduling special meetings. I <br />don't think that is the safest <br />approach, but that's the argument <br />that could be made. <br /> <br />Sisk: <br /> <br />What's our downside by taking action <br />on July 6? Given the fact that this <br />is a new bill and July 6 is a <br />regularly scheduled meeting, I don't <br />think anyone could quarrel with <br />that. By setting it at that time, <br />is there any downside? Is there any <br />basis for appeal? The last thing I <br />want to do is to go through with an <br />initiative and then have it defeated <br />in Court. I don't want to be the <br /> <br /> <br />
