ORDINANCE NO. 1710 <br />SERIES 2015 <br />AN ORDINANCE APPROVING A 5TH AMENDMENT TO THE TAKODA GENERAL <br />DEVELOPMENT PLAN (GDP) TO ALLOW UP TO 231 RESIDENTIAL UNITS AND UP <br />TO 64,468 SQUARE FEET OF COMMERCIAL DEVELOPMENT FOR THE <br />PROPERTY KNOWN AS THE 245 NORTH 96TH STREET ANNEXATION <br />WHEREAS, the City Council by Ordinance No. 1680, Series 2015, previously <br />approved an amendment to the Takoda General Development Plan (Takoda GDP) to <br />zone property known as the 245 North 96th Street Annexation as Planned Community <br />Zone District (PCZD — C /R) for the uses permitted in the Takoda GDP amendment <br />accompanying such Ordinance; and <br />WHEREAS, the Boulder County Housing Authority, the owner of 245 North 96th <br />Street, has submitted to the City a request for approval of a 5th amendment to the <br />Takoda GDP to expand the allowed commercial development from 18,406 square feet <br />to 64,468 square feet and to make other revisions to the Takoda GDP provisions in <br />connection therewith; and <br />WHEREAS, after a duly noticed public hearing on November 12, 2015 <br />concerning said amendment to the Takoda GDP, where evidence and testimony were <br />entered into the record, including without limitation the findings in the Louisville Planning <br />Commission Staff Report dated November 12, 2015, the Planning Commission <br />recommended approval of such amendment to the City Council; and <br />WHEREAS, the City Council has duly considered the Planning <br />Commission's recommendation; and <br />WHEREAS, the City Council has held a duly noticed public hearing on the <br />proposed amendment to the Takoda GDP, at which evidence and testimony were <br />entered into the record, including without limitation the findings in the City Council staff <br />report and other documents as listed in such report; and <br />WHEREAS, based on the evidence and testimony in the record, the City Council <br />finds that the proposed amendment to the Takoda GDP complies the 245 North 96th <br />Street Annexation Agreement, the Louisville zoning and subdivision regulations and <br />other applicable sections of the Louisville Municipal Code, and that the proposed <br />amendment to the Takoda GDP should be approved; <br />Ordinance No. 1710, Series 2015 <br />Page 1 of 2 <br />
