Sisk was uncomfortable with the fact that seemingly they are <br />negotiating on the fly, when in fact this is the kind of thing that <br />he thought should be presented to him in a final document. He <br />suggested that the matter be tabled and to continue it for two <br />weeks, letting the attorneys get together to get this done, so <br />Council can see a final document. <br /> <br />Bellock: <br /> <br />Paragraph 1 prohibits our requesting <br />annexation to any other entity. My <br />attorney said that it should have <br />added to it, " .... while the city is <br />in the process of acting upon the <br />exhibit." It would not be a <br />lifetime prohibition, if the city <br />then annexed, but prevented any <br />further development. <br /> <br />Sisk: <br /> <br />Doesn't paragraph 3 say that we'll <br />act on Exhibit B in six months? I <br />would suggest that we move it up two <br />weeks, because I think that you're <br />raising some points that need to be <br />discussed. <br /> <br />Bellock was concerned that paragraph 17 the City Attorney has <br />agreed to, paragraph 13 the City Attorney has agreed to, and with <br />regard to paragraph 7 and 1, if these are standard items, which the <br />rest of the project has already agreed to, then he felt that it <br />sounded like there isn't much more discussion to be had. <br /> <br />Griffiths: <br /> <br />There is a provision, paragraph 21, <br />that says the agreement is null and <br />void, if the city fails to approve <br />the annexation. <br /> <br />Davidson asked if there was a motion to approve the agreement, as <br />amended. <br /> <br />Sisk: <br /> <br />Yes, there is. <br /> <br />Howard seconded.
