the applicant may request an exemption from the alteration certificate requirement. The <br />request must be in the form provided by the Commission. <br />B. Notice of the public hearing shall be given as required by Section <br />15.36.110.D of the City Code. <br />C. A record of the hearing shall be kept by electronic device. The hearing <br />shall proceed in the following order: <br />1. Steps 1 -6 as listed above Article VII, Section 1, C. <br />7. After all members of the public who wish to do so have spoken and <br />the applicant has been given the opportunity to respond to the <br />public comments, the Chairman shall close the public hearing. The <br />Commission shall then discuss the application and decide the <br />matter according to the criteria set forth in Section 15.36.130 of the <br />City Code. If the Commission determines that more evidence is <br />necessary, or that additional time is needed to prepare written <br />findings and a decision, the hearing shall be continued for this <br />purpose. However, the Commission's decision to approve, modify <br />and approve, or disapprove the proposal, must be made within the <br />time limits set forth in Section 15.36.140 of the City Code. <br />8. If appropriate, the Commission shall issue an exemption certificate <br />as soon as practical after the Commission's findings are entered. <br />9. The decision of the Commission may be appealed to City Council <br />as provided for by Section 15.36.160 of the City Code. <br />Section 4. Neglect of landmarked properties. If the owner of any landmarked <br />property allows that property to suffer from neglect, as provided for in Section 15.36.190 <br />of the City Code, the Commission shall discuss the matter at a public meeting. If the <br />Commission determines that further investigation is necessary, the Commission shall <br />appoint one or more members of the Commission or City staff to investigate the matter <br />and report any findings at the next meeting on of the Commission. If appropriate, the <br />Commission shall thereafter send a notice to the property owner, as provided for in <br />Section 15.36.190.0 of the City Code. <br />Section 5. Applications for permits to demolish or relocate non - landmarked <br />properties over fiftv years old. <br />A. A City staff member and two randomly selected members of the Commission <br />shall review all permit applications for demolition, relocation or removal of buildings that <br />are over fifty years old within fourteen days after the Building Division accepts a <br />completed permit application, as provided by Section 15.36.200 of the City Code. If one <br />or both of the Commission members are unable to participate in the review within <br />fourteen days, the city staff member shall continue to randomly select names until two <br />members of the Commission are available. <br />Page 11 of 14 <br />
