select a Commission member to meet with the property owner, as required by Section <br />15.36.060.A of the City Code. If the first randomly selected Commission member is not <br />available within a reasonable time, the City Manager or the Manager's designee shall <br />continue to randomly select members until one is available. <br />B. Once the application is complete, notice of the public hearing shall be <br />given as required by Section 15.36.060.B of the City Code. <br />C. A record of the hearing shall be kept by electronic device. The hearing <br />shall proceed in the following order: <br />1. The Chairman shall call the hearing to order. <br />2. All Commission members shall disclose any conflicts of interest <br />pursuant to the City's Code of Ethics, and shall not participate in <br />any proceedings in which they have an interest, as defined by the <br />Code. Commission members shall also disclose on the record any <br />ex parte contacts they have had regarding the application. <br />3. The City Staff shall make a presentation to the Commission <br />regarding the facts and findings of the application. <br />4. The applicant shall be invited to make a presentation. The applicant <br />shall provide accurate factual information sufficient for the <br />Commission to determine whether the application meets the <br />applicable criteria. <br />5. Any members of the public who wish to testify shall be invited to do <br />so. Speakers shall state their names and addresses. The <br />Commission may limit the time for each person's comments and <br />may limit repetitive testimony. <br />6. The applicant has the option to respond to the public testimony. <br />The Commission may limit the time for the presentation. The <br />Commission may ask questions of the applicant and witnesses. <br />7. After all members of the public who wish to do so have spoken and <br />the applicant has been given the opportunity to respond to the <br />public comments, the Chairman shall close the public hearing. The <br />Commission shall then discuss the application and determine if the <br />applicable criteria as contained in Section15.36.050 of the City <br />Code are met. If the Commission determines that more evidence is <br />necessary, or that additional time is needed to prepare written <br />findings and a decision, the hearing shall be continued for this <br />purpose. However, the Commission's decision to approve, modify <br />and approve, or disapprove the proposal, and the recommendation <br />to City Council, must be made within the time limits set forth in <br />Page 9 of 14 <br />
