(Maintenance) <br />REGION 1 -wma <br />SAP # 331000513 <br />FOR CDOT TRACKING PURPOSES <br />(subject to chin). <br />INTERGOVERNMENTAL AGREEMENT <br />THIS INTERGOVERNMENTAL AGREEMENT ( "Agreement ") is made this /6'iday <br />of i' /1a4u�1 2016, by and between the State of Colorado for the use and benefit <br />of the COLORADO DEPARTMENT OF TRANSPORTATION ( "State" or "CDOT "), and <br />the City of Louisville ( "Local Agency "), 749 Main Street, Louisville, CO, 80027, CDOT <br />Vendor #: 2000114. <br />This Agreement shall not be effective or enforceable until it is approved and signed by the <br />Governor or his designee ('`Effective Date "). <br />RECITALS <br />1. Required approval, clearance and coordination have been accomplished from and with <br />appropriate agencies. <br />2. The parties desire to enter into this Agreement to delineate each one's responsibilities <br />for maintenance of the US 36 and McCaslin Boulevard (also known as SH 170) interchange <br />that is being built as part of the US 36 Managed Lane Project detailed in Exhibits A and C; <br />3. The State and the Local Agency have the authority, as provided in Sections 29 -1 -203, <br />43 -1106, 43 -2 -103, 43 -2 -104, and 43 -2 -144 CRS, as amended, and in applicable ordinance <br />or resolution duly passed and adopted by the Local Agency, to enter into this Agreement <br />with the Local Agency for the purpose of maintaining the interchange along a US highway <br />system as hereinafter set forth; <br />4. The Local Agency has the resources to perform the desired maintenance on the <br />McCaslin Boulevard interchange; <br />5. The US 36 Managed Lane Project has been cleared environmentally via the US 36 EIS <br />Phase 1 Record of Decision (ROD) signed December 2009, and will be funded with local, <br />state, TIFIA loan, and federal -aid dollars; and <br />6. Per the EIS re- evaluation signed March 2013 the Project will include improvement to <br />the US 36 and McCaslin Boulevard interchange, including widening of Structure E -17 -KZ <br />and the reconfiguration of the existing interchange into a Diverging Diamond interchange. <br />Maintenance of the McCaslin Boulevard Interchange will be the joint responsibility of the <br />local jurisdictions and CDOT through one or more Intergovernmental Agreements. <br />Page 1 of 9 <br />
