If you'll look on the <br />first page, it's clearly the <br />District that you're dealing with, <br />because in the preamble it says it's <br />the NCWCD acting by and through this <br />government owned business. <br /> <br />Mayer wanted Mr. Shimmin to comment on 3.b., Page 3, the <br />consequences to the city on this contract in accord with C.R.S. 37- <br />45-.101. <br /> <br />Shimmin stated that the statutory reference was a description of <br />the entirety of the Water Conservancy District Act, which is the <br />legislation that regulates how the Northern District and its sub- <br />district can operate. <br /> <br />Mayer stated in "c.iii.," Hydroelectric Power Potential, "The <br />Participants shall have the right to participate .... ," it doesn't <br />sas· that the users could drive any revenue from that. He felt <br />that, if the city was paying to help construct it, the city would <br />want the profits as well. <br /> <br />Dreher: <br /> <br />That's our intent. This was inserted in <br />case something came up in the <br />future. <br /> <br />Davidson stated that in "c.i.," it says any excess capacity belongs <br />solely to the pipeline company. He wondered if the pipeline users <br />jointly pay for that. If so, why doesn't it belong proportionally <br />to the pipeline users? <br /> <br />Dreher: <br /> <br />It would. The problem that this <br />language is intended to address is <br />that the Carter Lake Outlet Works <br />consists of two parts: the <br />Federally owned part that we operate <br />and maintain on a contract with the <br /> <br /> <br />
