City Council Water Committee
Meeting Minutes
April 20, 2007

which was followed by a discussion on; how, where and when the
rights are available.

c. Lease Opportunities - summarized past, current and potential leases.
Staff will continue to lease out surplus water when the opportunity
anses.

VII. Update - Water Projects - City Staff summarized the current status of the
following projects:

a. Windy Gap Firming Project - The Bureau of Reclamation continues to
review the documents related to the projects EIS. A more thorough
review at this time may reduce issues at a later time. The draft EIS is
expected late summer with the Final EIS and ROD about six months
later. The schedule for the design work and construction has been
pushed out 6+ months which, helps the City since the water is not
likely to be needed in the near future.

b. Interconnect - A few warranty items remain but, the remainder of the
project has been settled.

c. SWTP Emergency Generator - Council recently approved the
purchase of the generator equipment. Staff is working with the
consultant to prepare construction documents for the installation of the
generator. The installation will take place next fall, after water
demands have fallen.

VIII. Legal - City Staff summarized the current status of the following items:

a. City of BoulderlCommunity Ditch - Still waiting on the ruling from the
Court.

b. Marshall LakelSouth Boulder and Coal Creek Ditch Transfer - The
effort on the IGA with Boulder and the Boulder/FRICO case had
temporarily slowed the Water Court Application, which will now get
back on track.

IX. DISCUSSION ITEMS FOR NEXT MEETING

The next meeting will likely be in late July or early August once the water
situation is well in hand.
