ORDINANCE NO. 15:30 SERIES 2008 AN ORDINANCE AUTHORIZING AN EXCHANGE WITH THE COLORADO DEPARTMENT OF TRANSPORTATION OF RIGHT-OF-WAY PARCELS ASSOCIATED WITH THE CONSTRUCTION OF TF[E SOUTH 96TH STREET/STATE HIGHWAY 42 CONNECTION PROJECT WHEREAS, the City has completed the South 96th Street/State Highway 42 connection Project (the "Project"); and WHEREAS, the Project included construction of 1:he connection of South 96th Street, a City street, to State Highway 42, a Colorado state highway, and completion of associated intersection and traffic signal improvements; and WHEREAS, the Project included the relocation of a portion of State Highway 42 from right-of--way owned by the Colorado Department of Transportation (CDOT) to right-of--way acquired by the City for the Project; and WHEREAS, it has been proposed that the City and CDOT exchange the City-owned right- of-way needed by CDOT for the reconstructed portion of State Highway 42, for the CDOT-owned right-of--way previously used for State Highway 42; and WHEREAS, the City-owned right-of--way to be conveyed to CDOT is legally described and depicted in Exhibit A, attached hereto and incorporated herein by reference (the "City Right-of- Wa}~'); and WHEREAS, the CDOT-owned right-of--way to be conveyed to the City is legally described and depicted in Exhibit B, attached hereto and incorporated herein by reference (the "CDOT Right- of-Wad'); and WHEREAS, the City Council finds that an exchange of the City Right-of--Way for the CDOT Right-of--Way is consistent with the Project plans and specifications and with the City's plans for the area within which the parcels are located; and WHEREAS, the City Council has determined that tYie City Right-of--Way is not being used or held for any purpose of the City, and that it is in the best interest of the City to exchange the City Right-of--Way for the CDOT Right-of--Way upon the terms and conditions set forth herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The City Council hereby approves, the conveyance from the City of Louisville to the Colorado Department of Transportation ("CDOT") of that certain real property legally described and depicted in Exhibit A, attached hereto and incorporated herein by reference (the "City Right-of-Wa}~'), upon the terms and conditions set forth in this ordinance.
