RESOLUTION N0.29 <br />SERIES 2008 <br />A RESOLUTION APPROVING A PURCHASE CONTRACT TO BUY AND SELL REAL <br />ESTATE FOR ACQUISITION OF CERTAIN RIGHT'-OF-WAY REQUIRED FOR THE <br />DILLON ROAD PROJECT <br />WHEREAS, the City of Louisville has previously authorized and approved the Dillon <br />Road Project for reconstruction of, and drainage and roadway improvements on and adjacent to, <br />Dillon Road (hereinafter referred to as the "Project"); and <br />WHEREAS, the Project is for a public use and purpose; and <br />WHEREAS, it is necessary to acquire for the Project the property more particularly <br />described in Exhibits A-1 and B-1 to the agreement accompanying this Resolution (hereinafter "the <br />Property"); and <br />WHEREAS, a Purchase Contract to Buy and Sell Real Estate (the "Purchase Contract") has <br />been proposed for the City's acquisition of the Property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The proposed Purchase Contract between the City of Louisville and David Keown, <br />for the City's acquisition of the Property which is described in Exhibits A-1 and B-1 to such <br />Purchase Contract, is hereby approved in essentially the same form as the copy of such Purchase <br />Contract accompanying this Resolution. <br />2. The Mayor is authorized to execute the Purchase Contract, except that the Mayor is <br />hereby granted the authority to negotiate and approve such revisions to said Purchase Contract as <br />the Mayor determines are necessary or desirable for the protection of the City, so long as the <br />essential terms and conditions of the Purchase Contract are not altered. <br />3. The Mayor, City Manager, and City Staff ~~re further authorized to do all things <br />necessary on behalf of the City to perform the obligations of the City under the Purchase Contract, <br />and to execute and deliver any all closing documents and other documents necessary to effect the <br />purchase of the Property under the terms and conditions of the Purchase Contract. <br />PASSED AND ADOPTED this ~~ day ~ <br />
