RESOLUTION N0.29 SERIES 2008 A RESOLUTION APPROVING A PURCHASE CONTRACT TO BUY AND SELL REAL ESTATE FOR ACQUISITION OF CERTAIN RIGHT'-OF-WAY REQUIRED FOR THE DILLON ROAD PROJECT WHEREAS, the City of Louisville has previously authorized and approved the Dillon Road Project for reconstruction of, and drainage and roadway improvements on and adjacent to, Dillon Road (hereinafter referred to as the "Project"); and WHEREAS, the Project is for a public use and purpose; and WHEREAS, it is necessary to acquire for the Project the property more particularly described in Exhibits A-1 and B-1 to the agreement accompanying this Resolution (hereinafter "the Property"); and WHEREAS, a Purchase Contract to Buy and Sell Real Estate (the "Purchase Contract") has been proposed for the City's acquisition of the Property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Purchase Contract between the City of Louisville and David Keown, for the City's acquisition of the Property which is described in Exhibits A-1 and B-1 to such Purchase Contract, is hereby approved in essentially the same form as the copy of such Purchase Contract accompanying this Resolution. 2. The Mayor is authorized to execute the Purchase Contract, except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said Purchase Contract as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Purchase Contract are not altered. 3. The Mayor, City Manager, and City Staff ~~re further authorized to do all things necessary on behalf of the City to perform the obligations of the City under the Purchase Contract, and to execute and deliver any all closing documents and other documents necessary to effect the purchase of the Property under the terms and conditions of the Purchase Contract.
