Dave Stahl, Homart ]Development Co., stated Homart <br />has initiated a Extension Agreement with Frontier <br />Materials that contains a 90 day cancellation <br />clause. Stahl explained that as soon as the golf <br />course bonds are so:1d and the golf course <br />construction begins,, Homart's intent is to issue <br />the 90 day notice with Frontier to have all the <br />gravel removed from the site. Frontier has agreed <br />to this condition. <br />Mayor Fauson opened the public hearing. <br />Szymanski stated that he would be more comfortable <br />if the City were a party to the 90 day condition <br />to the Agreement an~i the sooner the operation is <br />complete, the bettez- Szymanski would feel about <br />it. <br />Mayor Fauson asked f`or anyone wishing to speak <br />either in favor of c>r in opposition to this <br />Extension Agreement with Frontier. None. <br />Mayor Fauson closed the public hearing and called <br />for a motion. <br />Anderson moved that the Temporary Use Permit <br />Extension for Frontier Sand Gravel be approved <br />with a condition that if required the process be <br />completed within 90 days upon request by Homart <br />and/or the City, and. all other conditions of the <br />original Temporary Use Permit (excluding crushing <br />activities) become part of this Extension <br />Agreement. Szymanski seconded the motion. By <br />Roll Call Vote the motion passed unanimously. <br />AMENDMENT TO SPECIAL REVIEW USE AGREEMENT - P'OW WOW GROUNDS - <br />PUBLIC HEARING Mayor Fauson opened the public hearing and asked <br />staff for a summary. <br />Wanush explained that as per the Special Review <br />Use Agreement, Mr. Schempp submitted a request to <br />operate motor racing on the Louisville Fairgrounds <br />site. This use was not on the list of approved <br />uses and the request was denied. Mr. Schempp then <br />requested that motor racing be added to the list <br />requiring Council approval. At Council's March 15 <br />Meeting, Council reviewed this request and <br />requested that the applicant provide additional <br />information relating to the activity and to the <br />noise generated. Council also requested that the <br />issue be advertised for a public hearing and <br />notices sent to Louisville residents within 200 <br />ft. of the Fairgrounds. Tonight is that public <br />hearing. <br />5 <br />
