Dave Stahl, Homart ]Development Co., stated Homart
has initiated a Extension Agreement with Frontier
Materials that contains a 90 day cancellation
clause. Stahl explained that as soon as the golf
course bonds are so:1d and the golf course
construction begins,, Homart's intent is to issue
the 90 day notice with Frontier to have all the
gravel removed from the site. Frontier has agreed
to this condition.
Mayor Fauson opened the public hearing.
Szymanski stated that he would be more comfortable
if the City were a party to the 90 day condition
to the Agreement an~i the sooner the operation is
complete, the bettez- Szymanski would feel about
it.
Mayor Fauson asked f`or anyone wishing to speak
either in favor of c>r in opposition to this
Extension Agreement with Frontier. None.
Mayor Fauson closed the public hearing and called
for a motion.
Anderson moved that the Temporary Use Permit
Extension for Frontier Sand Gravel be approved
with a condition that if required the process be
completed within 90 days upon request by Homart
and/or the City, and. all other conditions of the
original Temporary Use Permit (excluding crushing
activities) become part of this Extension
Agreement. Szymanski seconded the motion. By
Roll Call Vote the motion passed unanimously.
AMENDMENT TO SPECIAL REVIEW USE AGREEMENT - P'OW WOW GROUNDS -
PUBLIC HEARING Mayor Fauson opened the public hearing and asked
staff for a summary.
Wanush explained that as per the Special Review
Use Agreement, Mr. Schempp submitted a request to
operate motor racing on the Louisville Fairgrounds
site. This use was not on the list of approved
uses and the request was denied. Mr. Schempp then
requested that motor racing be added to the list
requiring Council approval. At Council's March 15
Meeting, Council reviewed this request and
requested that the applicant provide additional
information relating to the activity and to the
noise generated. Council also requested that the
issue be advertised for a public hearing and
notices sent to Louisville residents within 200
ft. of the Fairgrounds. Tonight is that public
hearing.
5
