Mr. Dziewit feels <br />that the City is not sensitive to the homeowners <br />in this area. <br />Stahl stated that the City of Louisville and the <br />Boulder County Commissioners were approached <br />regarding the sharing of costs of undergrounding <br />the lines along McC'aslin Blvd. as well as along <br />88th Avenue (located in Boulder County). Council <br />decided not to shares the costs with Boulder County <br />in upgrading these lines as there was a $75,000 <br />difference {$37,500 for the City) as the money was <br />not budgeted in the 1988 Budget. The current City <br />code and policies would indicate that the City <br />should not have participated in that <br />undergrounding. "Tree portion north and out of the <br />City, we had no control over. The area to the <br />south which is more duly west of the Hilltop area <br />and not the Hillsborough area, code and policy <br />requires that we would underground that particular <br />segment at the developers expense at the time of <br />subdivision and development and installation of <br />infrastructure on those particular parcels <br />adjacent to the po~werlines. The area that has <br />been undergrounded is currently within the City <br />east and west of MrCaslin Blvd. Its the City's <br />Parcel S1 Open Space~...as well as a portion on the <br />east side of the McStain development and a portion <br />of Homart' s Parcel D down to Via Appia and <br />McCaslin intersection. That was done in <br />conjunction with i:he construction of the new <br />McCaslin Blvd. and t:he re-routing of McCaslin." <br />"With regard to the approximately $380,000 that <br />the City of Louisville received from Public <br />Service, it was not a rebate to the City of <br />Louisville, but in :Fact we are custodian of those <br />funds." It is clearly outlined by State statutes <br />how the City is to :handle these funds. It is not <br />within Council's ability to budget those funds for <br />other electrical, general funds issues, capital <br />improvement issues. Those funds must be escrowed <br />and locate the developers and refund the money <br />directly to them. <br />Stahl stated that with regard to the landscaping <br />issue along McCaslin Blvd. there are two parties <br />responsible for landscaping. The Hilltop area has <br />not been accepted at the construction level by <br />McStain as they need to do native seeding and some <br />trees and shrubs. That will occur during the <br />appropriate planting season this fall. The PUD <br />that was accepted consisted of treatment of native <br />seeding along with t:he trees and shrubs.
