October 18th Council meeting as the agreement has <br />not been finalized. <br />Mayor Fauson asked if anyone was present that <br />wished to speak to the Ordinance. None. <br />Mayor Fauson moved and Sackett seconded to <br />continue the public: hearing on Ordinance #965, <br />Series 1988 until October 18, 1988. Motion passed <br />unanimously. <br />ORDINANCE #966 - AIRCRAFT REGULATION - 1ST READING - SET PUBLIC <br />HEARING Ordinance #966, SeY•ies 1988, "An Ordinance adding <br />a new Chapter 8.60 to the Louisville Municipal <br />Code restricting the operation of aircraft within <br />the City limits." <br />Stahl informed Council that during the past <br />several weeks, it has come to staff's attention <br />that certain sections of the Municipal Code do not <br />adequately protect the health, safety and welfare <br />of its citizens with regard to the use of certain <br />areas of the City as an airport. <br />Approximately three weeks ago, the City Attorney <br />filed a request in District Court to gain an <br />injunction to preclude the pilot from landing his <br />aircraft on Taylor Street in the Colorado Tech <br />Center. There was .a hearing in front of Judge <br />McClean last week. Prior to the hearing there <br />was a stipulation which outlined that the pilot <br />agreed not to land ]his plane on public right-of- <br />ways but felt that ]he had the right to land the <br />plane in a field adjacent to the public right-of- <br />way. The Judge did not issue the injunction <br />precluding him from landing in private areas <br />within the corporatE~ limits of Louisville. It is <br />staff's position that the City has available in <br />the zoning ordinance' the opportunity for those <br />that wish to operate' an airport or private <br />airstrip to make an application for special <br />review use approval which would be reviewed by the <br />Planning Commission and subsequently by the City <br />Council that would outline and designate certain <br />areas that could be used for an airport or an <br />airstrip. In the ak~sence of an application, it is <br />apparent in the Judge's ruling that the pilot <br />could continue to land within a proximity that <br />could be of danger t.o buildings within the <br />Colorado Tech Center and the occupants of those <br />buildings. <br />In order to clarify the code, Ordinance #966 has <br />been drafted for Council consideration and <br />approval.
