Mohr stated that he is concerned that the City not
send out a message to general aviation that the
City is unfriendly to them. "I would like to make
it clear that we are: not."
Mayor Fauson stated that it is his understanding
that the City does n.ot have jurisdiction over
aircraft until it is actually on the ground.
Williamson concurred.. The FAA has strict
restrictions regarding the altitude of aircraft.
Williamson suggested. that the Ordinance be re-
worded to have language controlling landing and
take-off from City F~roperty. Williamson suggested
that under Section 8.60.030 Prohibitions wording
be added in the parenthetical at the end of the
text, "or unless the: aircraft is regulated by
FAA", so that we would then exempt any regulated
aircraft from the height limitation. The
Ordinance could then. be adopted as amended and
republished in its entirety.
Mohr moved that Ordinance #966 be adopted with the
amendment added as stated by Williamson to include
under Section 8.60.030 Prohibitions wording be
added in the parenthetical at the end of the text,
"or unless the aircraft is regulated by the FAA."
Mayor Fauson moved t.o second Mohr's motion and
called for a roll call vote. By Roll Call Vote,
Ordinance #966, Series 1988 was adopted as amended
6-0.
ORDINANCE #967 - SERIES 1988 - PCZD REVISION - 1ST READING -
SET PUBLIC HEARING Read by title only, Ordinance #967, Series 1988,
"An Ordinance amending Section 17.72.020 of the
Louisville Municipal. Code relative to minimum area
requirements for a Planned Community Zone
District." Staff i~~ seeking Council approval to
place the ordinance out for publication and a
public hearing held on November 1, 1988.
Franklin explained ghat the Planned Community Zone
District (PCZD) currently is available to
properties of 160 acres or larger in size, or to
smaller properties adjoining a PCZD District. By
this ordinance the minimum area will be reduced
from 160 acres to 30 acres. All other
requirements will remain. Planning Commission has
been advised of thi:> proposed change and has no
objection provided t:he review process and
regulations remain intact.
Mayor Fauson moved and Sackett seconded to place
Ordinance #967, Series 1988 out for publication
3
