and Grill. According to Municipal Code, outdoor <br />dining in the CommE~rcial Business zone required <br />special review. TYieir proposal is to serve food <br />and liquor on the outside patio and on the south <br />end of the restaurant near the basketball and <br />volleyball courts. Planning Commission approved <br />the use April 14, ].987. <br />Anderson asked if alcohol is going to be served on <br />the volleyball coux-t. Wanush explained that it <br />would not be as that would be against State Liquor <br />Laws. Szymanski asked how the alcohol on the <br />patio would be contained and how that would be <br />monitored so that alcohol would not get to the <br />volleyball/basketball area. <br />Chris Engles, owner-/applicant, stated that gates <br />have been placed at: both ends of the patio to <br />contain patrons; access to and from the patio <br />would be through the building. Also, management <br />would be extremely cautious and monitor the area <br />continuously. <br />Mayor Fauson moved that Resolution #8 would be <br />approved. Mohr sec:onded. Unanimous. <br />RESOLUTION #9 - WINDSONG PLACE REPEAT AND PLJD <br />AMENDMENT Rautenstraus read in its entirety Resolution #9, <br />Series 1987, "A Resolution approving a final <br />replat and PUD amendment for Windsong <br />Subdivision." <br />Wanush stated that the applicant requests five <br />changes to the Windsong Plat approved July 8th, <br />1986. The proposed. changes are modifications to <br />the drainage and utility easements. The PUD <br />amendment is to reduce the drainage and utility <br />easements. The PUL- amendment is to reduce the <br />front setbacks from 25 ft. to 20 ft. for lots 8 <br />and 9. Planning Commission recommended .approval <br />at the public hearing on April 14, 1987. <br />Mohr, referring to questions during the Planning <br />Commission public hearing, asked if engineering <br />approved of the drainage and utility easement <br />modifications. <br />Wanush stated that the engineering department <br />believes that none of these changes affect the <br />approved drainage plan. Phare stated that <br />drainage from the detention pond would drain <br />through the easement, into the alley, continue <br />east until tying into the storm drainage on Rex <br />Street. <br />5 <br />
