Harper, asked for a <br />clarification on the standard easement between <br />property lines and curbs for arterials and other <br />streets. Staff detailed the requirements and <br />standards explaining that there is a minimum of 18 <br />ft. between the property line and the curb along <br />McCaslin Blvd. from So. Boulder Rd. to Cherry <br />Street except in areas where it is greater due to <br />an additional waterline easement. Foster stated <br />he felt the minimum requirement was inadequate. <br />In response to a question by Anderson concerning <br />the ditch and liab~_lity, Rautenstraus responded: <br />"Whenever a person owns a piece of property they <br />are obligated to take reasonable steps to stop <br />damage or injury to other people. That is what <br />our (the City's) responsibility would be. The <br />City has the obligation to take reasonable steps <br />when necessary." <br />In response to a question by Szymanski, Drumm <br />explained that the City has no function in <br />restrictive covenance or the homeowners <br />association. <br />Mayor Fauson moved that Resolution #30 be <br />approved. Szymanski seconded. Unanimous. <br />RECESS A 10 minutes recess was called by Mayor Fauson at <br />this point. <br />RESOLUTION #31 - STATE SIGNALIZATION <br />AGREEMENT Rautenstraus read in its entirety Resolution #31, <br />"A Resolution authorizing the City of Louisville <br />to provide its share of the cost relative to the <br />agreement with the Colorado Dept. of Highways." <br />Phare explained that the Resolution approves the <br />City-State agreement for the So. Boulder Road <br />Traffic Signal Project and authorizes the Mayor to <br />execute the Agreement on behalf of the City. <br />Approval is necessary in order to obtain Federal <br />Aid Urban Funding for the Traffic Signal Project. <br />Mayor Fauson moved that Resolution #31 be adopted. <br />Szymanski seconded.
