Not everyone else in the <br />world is going to honor our Comprehensive Plan. <br />They will do whatever is best for their City and <br />that is the same thing we should do." <br />Mayor Fauson asked staff if the conditions spelled <br />out in the proposed annexation agreement were <br />agreed to by the property owners. Wanush stated <br />that they were agreed to by the applicants. <br />Mayor Fauson closed the public hearing and called <br />for further Council discussion. <br />Szymanski asked if the one conditions spelled out <br />by the Planning Commission regarding the buried <br />storage should in fact be specified as adequate <br />storage. This would then include any type of water <br />storage needed and thus not limiting it to buried <br />storage. Staff and Council concurred. <br />Also Szymanski referenced the condition of the <br />35' limitation. Wanush explained that the <br />building code has a 50' limitation in a CB zone. <br />Planning Commission made this condition so as to <br />be consistent with the height restriction for the <br />Homart Development as this is a major entrance to <br />the City that should have the view unobstructed. <br />Szymanski felt that the City should consider <br />having this same restriction on the south side of <br />U.S. 36 as well as the north side. <br />With no further discussion, Mayor Fauson moved <br />that Ordinance #906 be adopted with the six <br />conditions specified by the Planning Commission <br />and reword Condition #5 to read "adequate <br />storage". Mohr seconded. By Roll Call Vote, <br />Ordinance #906 was unanimously adopted. <br />ORDINANCE #907 - BIELLA/MENKICK ANNEXATION II <br />PUBLIC HEARING Rautenstraus read by title only Ordinance #907, <br />"An Ordinance annexing to the City of Louisville, <br />Colorado, a parcel of approximately 33.88 acres <br />located south of U.S. Highway 36, in Section 19 <br />which is owned by Richard F. Biella." Proper <br />publication and notice of public hearing were <br />established. <br />Mayor Fauson opened the public hearing. <br />Wanush briefly described the parcel in the <br />annexation request and asked that his comments <br />made during the presentation of Ordinance #906 be <br />a matter of record for this Ordinance as well. <br />9 <br />
