Mayor Fauson stated that while he appreciates <br />Szymanski's view on this issue, the flexibility is <br />needed for a variety of reasons including <br />topography and that Council should have the <br />ability to make that judgement at the time of the <br />PUD. <br />Sackett stated that past practice has not been <br />inconsistent with the ordinance, but outside the <br />ordinance in that the ordinance didn't actually <br />address the issue. This change would make clear <br />the intent of this ordinance. Sackett feels that <br />Council should have a public hearing on the <br />ordinance. <br />Mohr moved that Ordinance #916 be published and a <br />public hearing be set for October 7, 1986. Mayor <br />Fauson seconded. <br />Szymanski stated that for the sake of a public <br />hearing he would support this motion although he <br />doesn't like it. <br />The motion was unanimously approved. <br />RESOLUTION #42 - SUBDIVISION #1 - CENTENNIAL VALLEY <br />BUSINESS PARK Rautenstraus read in its entirety Resolution #42, <br />"A Resolution approving a final subdivision plat <br />for Centennial Valley Business Park Subdivision, <br />No. l." <br />Wanush explained that Homart Development Company <br />is requesting that Parcel G, as is approved in <br />their General Development Plan, be subdivided into <br />18 lots. The 55 acres is the first filing of the <br />Centennial Valley Business Park. Each of the lots <br />will come back to the Planning Commission for site <br />plans or PUD approval. <br />Wanush stated that for the record, access to <br />certain lots, 5,6, and 7 of Block 3 would present <br />a potential problem because of the intersection. <br />However, staff does not see that as a road block <br />to approving this subdivision agreement as it <br />could be resolved at the time of the PUD. <br />Planning Commission recommended approval with no <br />conditions. <br />Dave Stahl of the Homart Development Company <br />stated that bringing this agreement to Council at <br />this time would reduce the time frame required for <br />subsequent processing by the user of a parcel. By <br />going through this subdivision process now, the <br />only remaining process would be a PUD or site plan <br />5 <br />
