Leach: <br /> <br />Hornbostel <br />property. <br /> <br />wondered <br /> <br />about <br /> <br />We'll record covenants that will <br />establish the Homeowner's <br />Association against the property, <br />before we deed any lots to anybody. <br />We would be happy to provide those <br />to the City Attorney to review. <br /> <br />the foxes reported to live on the <br /> <br />Leach: <br /> <br />The foxes live off of the property <br />in a shed that one of the neighbors <br />has. <br /> <br />Hgrnbostel asked that before construction is begun, the Division of <br />Wildlife make sure that there are no foxes in dens on the property. <br /> <br />Davidson asked the City Attorney that since this property is <br />already annexed and zoned, is the City really obligated to use-by- <br />right to allow development. <br /> <br />Griffiths: <br /> <br />Yes, unless you wish to rezone it in <br />some fashion and you have some basis <br />for the rezoning. <br /> <br />Davidson stated that there are several exceptions to the RE zoning <br />being made, such as: some of the lot widths don't meet the minimum <br />requirements, some of the setbacks don't meet the minimum <br />requirements, proposed Lot 8 meets the provisions of RE zoning with <br />the exception of lot width, 100' minimum. He wondered why non- <br />standard lots are being allowed in the RE zoning and wondered what <br />the benefit to the City would be. <br /> <br />Wood: <br /> <br />It's clearly a variance. In our <br />discussions with the applicant we <br />have been very careful to state that <br />the margin of variance is under a <br />lot of scrutiny with City Council. <br />My intent was to show the amount and <br />the scope of the variance requested. <br />The lot width I define is different <br />than the lot frontage. The lot <br />frontage on a cul-de-sac is 35', 50' <br />otherwise. We've got a 12,000 s.f. <br />lot and the lot coverage is within <br />the RE zone requirements. We're <br />just trying to show the scope. <br /> <br />Davidson asked for an explanation on the sub-standard streets. <br /> <br />Phare explained that the standard street requirement is for the <br />reasonable ease and efficiency of maintenance.
