(Maintenance) <br />Regional Transportation District <br />REGION 1- wma <br />SAP # 331000515 <br />FOR CDOT TRACKING PURPOSES <br />(subject to change). <br />INTERGOVERNMENTAL AGREEMENT <br />THIS INTERGOVERNMENTAL AGREEMENT ("Agreement") is made this '?(.) day of <br />5 '7t)l1 fl 2016, by and between the State of Colorado for the use and benefit of the <br />COLORADO DEPARTMENT OF TRANSPORTATION ("State" or "CDOT"), and the City of <br />Louisville ("Local Agency"), 749 Main Street, Louisville, CO, 80027, CDOT Vendor #: 2000114. <br />This Agreement shall not be effective or enforceable until it is approved and signed by the Governor or <br />his designee ("Effective Date"). <br />RECITALS <br />1. Required approval, clearance and coordination have been accomplished from and with <br />appropriate agencies. <br />2. The parties desire to enter into this Agreement to delineate each ones responsibilities for <br />maintenance of the US 36 bikeway and bikeway facility as part of the US 36 Managed Lane <br />Project detailed in Exhibits A and C; <br />3. The State and the Local Agency have the authority, as provided in Sections 29-1-203, 43-1- <br />106, 43-2-103, 43-2-104, and 43-2-144 CRS, as amended, and in applicable ordinance or <br />resolution duly passed and adopted by the Local Agency, to enter into this Agreement with the <br />Local Agency for the purpose of maintaining a bikeway along a US highway system as <br />hereinafter set forth; <br />4. The Local Agency has the resources to perform the desired maintenance on the bikeway <br />within its jurisdiction; <br />5. The US 36 Managed Lane Project has been cleared environmentally via the US 36 EIS Phase <br />1 Record of Decision (ROD) signed December 2009, and will be funded with local, state, TIFIA <br />loan, and federal -aid dollars; and <br />6. Per the ROD signed December 2009 the Project will provide a bikeway facility adjacent to US 36 <br />connecting Boulder and Denver. Maintenance of the US 36 bikeway will be the responsibility of the local <br />jurisdictions through an Intergovernmental Agreement with CDOT . <br />THE PARTIES NOW AGREE THAT: <br />Page 1 of 9 <br />
