The propert~is needed to reconfigure State Highway 42 and provide
for a southward extension of 96t Street. The negotiated price for the property is
$250,000. In addition to the purchase price the City will make modifications and
improvement to irrigation ditches that are impacted by the project both on the 5.5-acre
parcel and the City owned parcel. Staff recommends the acquisition be approved through
resolution, which allows the Mayor to further negotiate terms of the purchase to the
extent it does not alter the essential terms of the agreement.

MOTION: Brown moved for Council approval of Resolution No. 10, Series 2003,
seconded by Levihn. She stated the Coal Creek Trail Connection final alignment is approximately
95% completed, however, at the March 17, meeting of the Louisville Open Space
Advisory Board, a resolution was passed opposing the current alignment. Their concern
centered on the bridge that traverses a drainage ditch under the Dillon Road Underpass.
She explained the drainage ditch was undergoing serious erosion on each bank directly
where the bridge has been placed. Building this bridge provided the most direct access
and shallow grade to the Dillon Road underpass and mitigated severe bank erosion and
greatly improved the water quality entering Coal Creek.
