Mayor Meier moved that the Special Liquor Permit
for the Chamber of Commerce be posted and
published and a Public Hearing set for June 18,
1985. Johnson seconded and the motion was passed
unanimously.
ORDINANCE #857 - WEEDS
PUBLIC HEARING Rautenstraus read by title only Ordinance #857,
"An Ordinance amending Chapter 8.08 of the
Louisville Municipal Code concerning
responsibility for cutting of weeds within the
City of Louisvil:le." The ordinance was properly
published in full May 8, 1985, Notice of Public
Hearing published May 15 and 22, 1985. Mayor
Meier open the PuY~lic Hearing.
Hioco gave a presE~ntation explaining in detail the
old ordinance, the present ordinance and the
proposed ordinance. The proposed ordinance
defines "weeds" and "cutting required" very
specifically. T]he control of weeds in an area
that is zoned agricultural would be accomplished
by spraying; it we>uld not require cutting.
Mayor Meier asked for public comments in favor of
or in opposition t:o Ordinance #857.
Dave Stahl, 407 McCaslin, Louisville, asked
Council for clarification with regard to
agricultural zoning that is provided for grazing
leases. Stahl asked how the Homart property fit
into the picture in terms of land that is zoned
commercial and re:~idential at this point, but yet
have agricultural uses and leases in place. Would
this be treated t:he same as agriculturally zoned
land?
Rautenstraus determined that this had not been
considered and the ordinance probably should be
amended to state ghat "land specifically used for
agricultural purposes or for crop purposes."
Mayor Meier closed the Public Hearing and called
for Counci 1 comments. Luce offered an amendment
to Ordinance 857, Section 8.08.020, "Any property
within the City which is zoned agricultural 'or
land which is actively used for grazing or
agricultural purposes' shall be exempt from the
requirements of this Section...." Morris seconded
and the amendment was approved unanimously.
Mayor Meier moved that Ordinance No. 857 be
adopted as amended,. Luce seconded. Luce spoke in
favor of the motion and thanked staff for the
presentation as it: helped clarify the ordinance.
5
