Mayor Meier suggested that part of the original wording in Condition #3, "All commercial develop- ment shall be limited to specific uses that are reasonably necessary to efficiently serve resi- dents of the Master Plan area", remain in the Master Plan and add wording to allow McStain the same option to earn incentive permits for building retail spate. Mayor Meier suggested that the hours of use not be dealt with in this agreement. Leary concurred and asked for a second to his amended motion. Morris seconded. Unanimous. The McStain Master Plan was unanimously approved as amended. ORDINANCE #875 - VICIOUS DOG - PUBLIC HEARING Rautenstraus read by title only Ordinance #875, "An Ordinance amending section 6.12.010 concerning 'Vicious Dogs' contained in the Louisville Municipal Code. The Ordinance was published in full as was proper notice of the Public Hearing. Mayor Meier opened the Public Hearing and asked for any public comments in favor of or in opposition to Ordinance #875. None. Morris stated that she agreed with the intent of the Ordinance but had concerns with the vagueness of the word "intent" under Section B. Mayor Meier closed the Public Hearing and moved that Ordinance #875 be adopted. Cussen seconded. By roll call vote, Ordinance #875 was adopted 6-1 with Morris voting no. ORDINANCE #876 - ARSON AND THEFT - PUBLIC HEARING Rautenstraus read by title only Ordinance #876, "An Ordinance amending Title 9 of the Louisville Municipal Code concerning arson, adding a section and amending the section concerning theft." The Ordinance was published in full as was the notice of the Public Hearing. Mayor Meier opened the Public Hearing and asked for public comments in favor of or in opposition to Ordinance #876. None. Mayor Meier closed the Public Hearing and Cussen moved that Ordinance #876 be adopted. Johnson seconded. 4
