He asked staff if they <br />felt that the March 15, 1994, proposal was adequate to meet the <br />Mann Theatre problem. <br /> <br />Phare stated that their data addressed the whole property. He <br />explained that two PUD's had been approved, both Mann Theatres and <br />Comfort Inn, subject to execution of the Subdivision Agreement. He <br />felt the intersection would function adequately with the original <br />18.2 acres developed with the square footage or less as identified <br />in the traffic study. That does not provide for the Bellock <br />property, the neighboring Morrison annexation parcel of <br />approximately 10 acres. <br /> <br />Lathrop did not see the March 15, 1994, option as viable at all. <br />He felt the two developers should have already resolved the street <br />issue themselves before the PUD was ever presented to Council. <br /> <br />Mayer felt the City's punch list should not be part of the <br />negotiations. That is between the City and Homart. <br /> <br />Davidson asked when the City's punch list was expected to be <br />completed. <br /> <br />Annette Brand, City Administrator, explained that the City had sent <br />Mr. Shonkwiler, Homart Development, a list of the ten different <br />projects. Also, staff had been looking at the list. In an August 9, 1993, letter to Annette Brand, City <br />Administrator, he had raised several of the issues and asked that <br />they be discussed in open forum, so resolution could be <br />accomplished early. As far as whether they can be forced to pay <br />fox' improvements to Dyer Road in the future as they apply for a <br />Plat or PUD on Parcel O, with regard to Homart's Development <br />Agreement, Homart cannot be forced to pay, because it is not part <br />of the public improvements which are enumerated within the body of <br />that document. He explained that they have absolutely no plans to <br />access Dyer Road at this time. As far as a benefit to Parcel L, <br />there may be some, such as the use of access from Parcel L to Dyer <br />Road for Mann Theatres and Colony Square. He stated that right now <br /> <br /> <br />
