All City and State law requirements have <br /> been met and based on these findings, the Local Licensing Authority approve the <br /> issuance of a beer and wine liquor license for Refuge Decor LLC. Lipton <br /> seconded. Roll Call Vote — Machado — yes, Lipton — yes, Tennessen — yes, <br /> Carlson — yes and Hervey— yes. License approved. <br /> B. Set Boundaries of Neighborhood and Public Hearing — New <br /> Application for Hotel and Restaurant Liquor License — OYSY, Inc. <br /> d/b/a Sushi Yoshi Restaurant — 917 Front Street Suite 100 <br /> Lipton moved the boundaries of the neighborhood be set as the city limits of the <br /> City of Louisville for the new liquor license application for OYSY, Inc. d/b/a Sushi <br /> Yoshi Restaurant and the public hearing be set for June 27, 2016 at 7:00 PM. <br /> Machado seconded. All in favor. <br /> C. Discussion/Direction — Rules of Procedure <br /> Authority Attorney Culley stated there could be some amendments to the rules of <br /> procedure to address the concerns the Authority has been discussing. She <br /> suggested one change could be to include a phrase saying State suspensions <br /> are not to be considered in imposing local suspensions. Any other changes the <br /> Authority desires could be done before the next meeting. <br /> Authority Attorney Culley suggested one potential change to make the process <br /> run smoother would be to set a show cause hearing two meetings out to allow for <br /> a stipulation to be presented at the next meeting. If the Authority chooses, they <br /> could reject the stipulation and hold the hearing as scheduled or give an <br /> opportunity for an amended stipulation to be presented. This would not require a <br /> change to the rules but could become a practice when show cause hearings are <br /> ordered. <br /> Authority members discussed the benefits and disadvantages of following that <br /> procedure and decided they could try it in the future. <br /> Authority members discussed whether State violations should be considered <br /> when imposing penalties for a local violation. Chairperson Tennessen suggested <br /> the Authority not change the rules at this point, but remember the Authority can <br /> reject a stipulation in any future show cause orders if they have a problem with <br /> the way the penalty was determined. <br /> Police Department Reports <br /> No report. <br /> Secretary's Report <br />
