RESOLUTION NO. 33, SERIES 1994, FINAL SUBDIVISION PLAT FOR THE <br />ARCHDIOCESE OF COLORADO <br /> <br />Paul Wood, Planning Director, stated that the applicant requested that the PUD portion of this <br />request be withdrawn and that the Final Subdivision Plat proceed as a Plat action only. Ihe Planning <br />Commission Resolution No. 1713, Series 1994, recommended approval of the Final Subdivision Plat <br />with six conditions of approval. The revised Final Subdivision Plat had addressed five plat revisions. <br />The sixth condition was for the applicant to enter into a Subdivision Agreement. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Donna Barr, representing the Archdiocese of Denver, stated they will be entering into a Subdivision <br />Agreement with the City of Louisville. She requested that the Resolution allow them to include in <br />the Subdivision Agreement reference to the two current existing access points on Via Appia and the <br />possibility of a right-in/right-out access on McCaslin Boulevard. <br /> <br />Ron Brotsman, attorney for the Zurich family who owns 10 acres further down McCaslin Boulevard. <br />He requested that the Subdivision Agreement include the idea that there is only a right-in/right-out <br />into the Parish from McCaslin. He commented that the Planning Commission agrees that there should <br />not be a full access turn into the St. Louis Paris property. <br /> <br />Don Shonkwiler, HD Delaware Properties, Inc. (Homart), 400 South McCaslin, Louisville, Colorado, <br />stated that what Brotsman suggested would be unprecedented in a Subdivision Agreement and bind <br />the hands of the City in their own interest for their own purposes. <br /> <br />Mayer suggested that all of the a~ questions be deferred to the PUD process, rather than included <br />in the Subdivision Agreement. <br /> <br />Sisk wanted a date on when the sidewalk on Via Appia would be constructed. <br /> <br />Ban' set the date as September 1, 1994. <br /> <br />Shonkwiler suggested October 1, 1994 for completion of the sidewalk. <br /> <br />Sisk agreed to October 1, 1994. <br /> <br />Davidson called for Council comments, questions, or motions. <br /> <br />Mayer moved that Council approve Resolution No. 33, Series 1994, Final Subdivision Plat for the <br />Archdiocese of Denver, St. Louis Parish with the six conditions recommended by the Planning <br />Commission with the express understanding that there is no commitment in any way for any <br />ingress/egress to this property under the Subdivision Agreement. Seconded by Sisk with the friendly <br />amendment that condition No. 3 be shown to be October 1, 1994. <br /> <br />4 <br /> <br /> <br />
