RESOLUTION NO. 31 <br />SERIES 2016 <br />A RESOLUTION APPROVING AN AMENDMENT TO AN AGREEMENT WITH THE <br />URBAN DRAINAGE AND FLOOD CONTROL DISTRICT FOR THE DRAINAGEWAY <br />A -2 IMPROVEMENTS PROJECT <br />WHEREAS, the City of Louisville ( "City ") and the Urban Drainage and Flood Control <br />District ( "District ") previously entered into an agreement to construct improvements to <br />Drainageway A -2 (Agreement No. 11- 04.03), which was subsequently amended by Agreement <br />No. 11- 04.03A and by Agreement No. 11- 04.03B and by Agreement No. 11- 04.03C and by <br />Agreement No. 11- 04.03D); and <br />WHEREAS, an amendment to the Agreement has been proposed between the City and <br />the District to provide for additional funding for the Project; and <br />WHEREAS, the City Council fmds that the proposed amendment in the best interests of the <br />City and its citizens. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The Proposed Amendment to Agreement Regarding Final Design, Right -of -Way <br />Acquisition and Construction of Drainage and Flood Control Improvements for Drainageway A -2, <br />City of Louisville and City of Lafayette(Agreement No. 11- 04.03E), is hereby approved in <br />essentially the same form as the copy of such Amendment accompanying this Resolution. <br />2. The Mayor is authorized to execute the Amendment on behalf of the City, except <br />that the Mayor is hereby further granted authority to negotiate and approve such revisions to said <br />Amendment as the Mayor determines are necessary or desirable for the protection of the City, so <br />long as the essential terms and conditions of the Amendment are not altered. <br />PASSED AND ADOPTED this 5th day of July, 20 6. <br />ATTEST: <br />Meredyth uth, City Clerk <br />Robert P. uckle, Mayor <br />Resolution No 31, Series 2016 <br />Page 1 of 1 <br />■ <br />
