WHEREAS, the City is authorized by law to enter into such an agreement, and the <br />City Council finds and determines that execution of the proposed agreement is in the best <br />interest of the City and its citizens; and <br />WHEREAS, the City Council by this ordinance desires to approve the proposed <br />boundary line agreement and authorize its execution; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City Council hereby approves that certain Boundary Line <br />Agreement between the City of Louisville and Karin S. Medina - Keller and Keith L. Keller, <br />the fee simple owners of the property known as 833 Jefferson Avenue, Louisville (the <br />"Agreement "), in substantially the same form as the copy of such Agreement <br />accompanying this Ordinance. <br />Section, 2. The Mayor is hereby authorized to execute the Agreement on behalf <br />of the City Council of the City of Louisville, except that the Mayor or City Manager are <br />hereby further authorized to negotiate and approve such revisions to the Agreement as <br />the Mayor or City Manager determines are necessary or desirable for the protection of the <br />City, so long as the essential terms and conditions of the Agreement are not altered. <br />Section 3. The Mayor, City Manager and City Staff are hereby authorized to <br />execute and deliver any other documents necessary or appropriate to effect the <br />provisions of the Agreement, including without limitation the execution, delivery or <br />acceptance of any quit claim deeds appropriate to the establishment of the common <br />boundary line as established by the Agreement. <br />Section 4. If any portion of this ordinance is held to be invalid for any reason, <br />such decision shall not affect the validity of the remaining portions of this ordinance. The <br />City Council hereby declares that it would have passed this ordinance and each part <br />hereof irrespective of the fact that any one part be declared invalid. <br />Section 5. All other ordinances or portions thereof inconsistent or conflicting <br />with this ordinance or any portion hereof are hereby repealed to the extent of such <br />inconsistency or conflict. <br />INTRODUCEq, READ, PASSED ON FIRST READING, AND ORDERED <br />PUBLISHED this _ / 4 day of , 2016. <br />r,rw <br />Robert .
