Bristow, JD, PLS <br />President and General Counsel <br />Flatirons, Inc. <br />3825 Iris Avenue, Suite 395 <br />Boulder, CO 80301 <br />BOUNDARY LINE AGREEMENT <br />THIS BOUNDARY LINE AGREEMENT (hereinafter "Agreement ") is made and entered into <br />this 5 day of o l l , 2016, by and between Karin S. Medina - Keller and <br />Keith L. Keller, whose address is -03 3 Jefferson Ave. Louisville, CO 80027, and the City of <br />Louisville, a Colorado home rule municipal corporation, whose address is 749 Main St, <br />Louisville, CO 80027 (Karin S. Medina - Keller, Keith L. Keller and the City of Louisville are <br />sometimes hereinafter referred to individually as a "Party," or collectively as the "Parties ", and <br />Karin S. Medina- Keller and Keith L. Keller are also sometimes hereinafter referred to <br />collectively as "Owners "). <br />RECITALS <br />A. WHEREAS, Karin S. Medina - Keller and Keith L. Keller represent and warrant they are <br />the owners in fee simple of that real property described in the deed recorded May 23, <br />2014 at Reception Number 3381585, of the records of the Boulder County Clerk and <br />Recorder, and the adjacent alley vacated by City of Louisville Ordinance No. 410, Series <br />1973, dated April 3, 1973, otherwise currently known as 833 Jefferson Ave. Louisville, <br />CO 80027 (the "Keller Property"); and <br />B. WHEREAS, the City of Louisville, represents and warrants it is the owner in fee simple <br />of that real property described in deed recorded October 20, 1976 at Reception Number <br />196748 of the records of the Boulder County Clerk and Recorder, otherwise currently <br />known as Memory Square Park (the "City Property"; the Keller Property and the City <br />Property are collectively referred to as the "Properties "); and <br />C. WHEREAS, the Keller Property is adjacent to and immediately north and east of the City <br />Property and the two Properties share a common boundary line; and <br />D. WHEREAS, there are discrepancies in the legal descriptions of the common boundary <br />line contained in historical deeds and surveys of the properties as well as numerous <br />discrepancies in the block configuration as demonstrated in numerous surveys of the area; <br />and <br />1 <br />
