RESOLUTION NO. 43 <br />SERIES 2016 <br />A RESOLUTION APPROVING A FINAL PLANNED UNIT DEVELOPMENT (PUD) <br />AND SPECIAL REVIEW USE (SRU) TO ALLOW FOR THE CONSTRUCTION OF A <br />NEW BUILDING WITH 5,700 SF OF COMMERCIAL SPACE, THE REMODEL OF THE <br />EXISTING HOUSE, AND OUTDOOR SALES AT 824 SOUTH STREET, LOT 1, <br />BLOCK 5, LOUISVILLE OLD TOWN <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application for approval of a final Planned Unit Development (PUD) plan and special <br />review use (SRU) to allow for the construction of a new building with 5,700 SF of <br />commercial space, the remodel of the existing house, and outdoor sales at 824 South <br />Street, Lot 1, Block 5, Louisville Old Town; and <br />WHEREAS, the City Staff has reviewed the information submitted and found <br />that, subject to conditions, the application complies with the Louisville zoning and <br />subdivision regulations and other applicable sections of the Louisville Municipal Code; <br />and; <br />WHEREAS, after a duly noticed public hearing on July 14, 2016, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated July 14, 2016, the Planning <br />Commission recommended approval of the PUD and SRU for 824 South Street, with <br />the following conditions: <br />1. The access area for the handicap parking space shall be moved on to the <br />property if the City determines in the future that the access area unduly restricts <br />the public sidewalk after the project is completed and in use. <br />2. The items outlined in the Public Works memo dated June 23, 2016 shall be <br />satisfied before recordation of the PUD. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br />Colorado does hereby approve a final Planned Unit Development (PUD) plan and <br />special review use (SRU) to allow for the construction of a new building with 5,700 SF of <br />commercial space, the remodel of the existing house, and outdoor sales at 824 South <br />Street, Lot 1, Block 5, Louisville Old Town, with the following condition: <br />1. The access area for the handicap parking space shall be moved on to the <br />property if the City, at its sole discretion, determines in the future that the access <br />area unduly restricts the public sidewalk after the project is completed and in use <br />or determines an alternative use of the right of way is desired. The property <br />owner shall be responsible for all costs associated with relocation of the parking <br />space, including restoration of the public right-of-way and payment of the parking <br />fee -in -lieu that is in place at the time the determination to relocate the parking <br />space is made. <br />Resolution No. 43, Series 2016 <br />Page 1 of 2 <br />
