Mayer stated that the voters voted to use 3/8% toward open space and now Council is saying that
this portion is going toward schools.

Davidson was concerned about the 3/8% open space tax and how it would be addressed in this
Ordinance. It appeared that 3% goes for the school impact fee, but if the Use Tax is being imposed
to make it the same as the Sales Tax, then the 3/8% has to go to the open space purchase.

Tanoue stated that if Council wanted to make the two enactments consistent with one another, an
amendment would have to be made to sub-section B to accomplish that.

Sisk asked the City Attorney to double check to make sure that the ballot question is being asked
correctly.

Howard moved that Council approve Ordinance No. 1157, Series 1994, and set a public hearing for
August 2, 1994, with the amendments as specified by the city Attorney. Seconded by Mayer. Roll
call was taken. Motion passed by a 7 - 0 vote.

ORDINANCE NO. 1158, SERIES 1994 - MAKING THE POSITION OF CITY TREASURER
APPOINTIVE RATHER THAN ELECTIVE IF APPROVED BY THE VOTERS OF THE
CITY OF LOUISVILLE, AND CALLING A SPECIAL ELECTION THEREON - 1ST
READING - SET PUBLIC HEARING 8/2/94

Tanoue read by title only Ordinance No. 1158, Series 1994, "An ordinance making the position of
City Treasurer appointive rather than elective if approved by the voters of the City of Louisville, and
calling a special election thereon."

Sharon Asti-Caranci, acting City Administrator, stated that this was discussed at the June 29 Work
Session and Council directed staffand the City Attorney to prepare this ordinance, so the issue could
be place on the November 8, 1994, Special Election ballot.

Davidson called for Council comments, questions, or motions.

Sisk moved that Council approve Ordinance No. 1158, Series 1994, and set the public hearing for
August 2, 1994. Seconded by Levihn. Roll call was taken. Motion passed by a 7 - 0 vote.

ORDINANCE NO. 1159, SERIES 1994 - MAKING THE PosmoN OF THE CITY CLERK

1159, Series 1994, "An ordinance making the position of
City Clerk appointive rather than elective if approved by the voters of the City of Louisville, and
calling a special election thereon."

9
