Paul Wood, Planning Director, stated that this annexation proposes to annex 92.29 acres as an <br />enclave parcel into the City of Louisville. Resolution No. 35, Series 1994, finding substantial <br />compliance of a petition for the Warembourg Annexation, was approved by City Council on June 7, <br />1994. <br /> <br />Howard called for the applicant's presentation. <br /> <br />NONE <br /> <br />Howard opened the public hearing calling for anyone wishing to speak on Ordinance No. 1152. <br /> <br />Greg Oxenfeld, 151 South Carter Court, Louisville, Colorado, reserved his right to make some <br />comments later. <br /> <br />Council had no objection. <br /> <br />Howard closed the public hearing and called for Council questions and comments. <br /> <br />Susan Gdffiths, City Attorney, spoke with Warembourg's attorney, who requested that the wording <br />in the proposed purchase contract saying that the annexation is conditional upon the property actually <br />being purchased, be placed in the annexation ordinance. She proposed that a new Section 4 be added <br />to this Ordinance No. 1152 reading "That said territory shall be disconnected from the city at the <br />option of Klubert and Helen Warembourg in the event the city fails to purchase the portion of the <br />annexed territory as described in the purchase contract to buy and sell vacant real estate and <br />conservation easement to which the city and Warembourgs are parties." <br /> <br />Mayer moved that Council adopt Ordinance No. 1152, Series 1994, on second and final reading, with <br />the amendments as proposed by the City Attorney. Seconded by Lathrop. Roll call was taken. <br />Motion passed by a 6 - 0 vote with Davidson being absent. <br /> <br />ORDINANCE NO. 1153, SERIES 1994 - AMENDING TITLE 17 OF THE LOUISVILLE <br />MUNICIPAL CODE ENTITLED "ZONING" BY ZONING PROPERTY OWNED BY <br />KLUBERT AND HELEN WAREMBOURG KNOWN AS THE WAREMBOURG <br />ANNEXATION - 2ND READING - PUBLIC HEARING- (PUBL. LSVL. TIMES - 6/11, 6/15, <br />6/22, 6/29, & 7/6) <br /> <br />C_nSffiths read by title only Ordinance No. 1153, Series 1994, "An ordinance amending Title 17 of the <br />Louisville Municipal Code entitled "Zoning" by zoning property owned by Klubert and Helen <br />Warembourg known as the Warembourg Annexation." <br /> <br />Paul Wood, Planning Director, stated that this would zone the 92.29 acre parcel AG, Agriculture, <br />consistent with the terms of the Purchase Contract and the proposed Subdivision Agreement. <br /> <br />3 <br /> <br /> <br />
