RESOLUTION NO. 44 <br />SERIES 2016 <br />A RESOLUTION APPROVING A FIRST AMENDMENT TO AGREEMENT FOR <br />DELEGATION OF ACTIVITIES, FOR THE BOULDER COUNTY COLLABORATIVE <br />CDBG-DR SUB -ALLOCATION FOR THE CITY OF LOUISVILLE RAW WATER <br />DIVERSION IMPROVEMENTS PROJECT <br />WHEREAS, the City of Louisville ("City") and the City of Longmont have previously <br />entered into an Agreement for Delegation of Activities dated April 5, 2016 for the City of <br />Louisville's Raw Water Diversion Improvements Project (Boulder County Collaborative CDBG- <br />DR Sub -Allocation, Grant No. B -13 -DS -08-001: INF -00006, hereinafter the "Agreement"); and <br />WHEREAS, an amendment to the Agreement has been proposed between the City and <br />the City of Longmont to further clarify the delegation of authority to the City of Louisville's City <br />Manager and to amend Appendix A - Work Program and Appendix B = Budget of the <br />Agreement; and <br />WHEREAS, the City Council finds that the proposed amendment is in the best interests of the City <br />and its citizens; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO: <br />1. The City Council hereby approves the proposed First Amendment to Agreement for <br />Delegation of Activities between the City of Louisville and the City of Longmont ("Amendment"), <br />in essentially the same form as the copy of such Amendment accompanying this Resolution. <br />2. The Mayor and City Manager, or either of them, is authorized to execute the Amendment on <br />behalf of the City, except that the Mayor and City Manager, or either of them, are each hereby <br />further granted authority to negotiate and approve such revisions to said Amendment as the Mayor <br />or City Manager determines are necessary or desirable for the protection of the City, so long as the <br />essential terms and conditions of the Amendment are not altered. <br />3.
