Roll call was taken. Council voted 4 - 3 with Davidson, Keany, and Howard voting "no."

RESOLUTION NO. 43, SERIES 1994 - FINAL PUD DEVELOPMENT PLAN FOR BANK
ONE CENTENNIAL VALLEY PARCEL O, FILING NO. 3 - CENTENNIAL
MARKETPLACE

Lathrop asked to be excused due to a conflict of interest, as he is a stockholder in the Lafayette State
Bank.

Davidson excused Lathrop.

Mayer disclosed that Mr. Drohman, President of Bank One in Louisville, is a next door neighbor of
his, but he did not feel it would impair his ability to judge this item fairly.

Sisk disclosed that he is stockholder in Financial Holdings.

Davidson stated that he is a shareholder in two other banks.

Peter Kernkamp, Planner, stated that this is for a 3,500 s.f., one-story banking facility with four drive-
thru lanes on Lot 6 of Centennial Marketplace. Planning Commission met on July 12 and approved
by a 6 - 0 vote Resolution No. 25 containing four conditions (SEE ATTACHED), which have been
addressed with the revised plans. Since the application had been reviewed, the applicant had
indicated a desire to install a blue, back lit fabric canopy facia with white lettering for the signs that
were originally proposed.

Sisk remembered that his law firm is doing some work for Bank One, so he asked to be excused.

Davidson excused Sisk.

Davidson called for staff questions.

Howard was disturbed that sometimes items are left off of the Planning Commission Agenda, such
as the above mentioned canopy.

Kernkamp stated that this came up after this item had come before the Planning Commission.

Howard preferred that everything go through process with all other items, so Council does not have
to deal with "pieces."

Davidson wondered if, concerning the signage, it were in compliance with the city's ordinances or
with the Centennial Marketplace PUD.

9
