RESOLUTION NO. 48 <br />SERIES 2016 <br />A RESOLUTION APPROVING A GRANT AGREEMENT WITH THE DEPARTMENT <br />OF PUBLIC SAFETY DIVISION OF HOMELAND SECURITY AND EMERGENCY <br />MANAGEMENT FOR THE COUNTY ROAD BRIDGE <br />WHEREAS, the Colorado Department of Public Safety, Division of Homeland Security <br />and Emergency Management has appropriated funds for disaster assistance and is distributing <br />appropriated funds to local governments; and <br />WHEREAS, the City of Louisville desires to participate in such grant funding for the <br />purpose of completing the bridge replacement, retaining walls, roadside safety features and <br />signing, striping, permanent and temporary erosion control, fencing and restoration of existing <br />features within the right-of-way for the County Road Bridge across Coal Creek damaged by the <br />September 2013 flood; and <br />WHEREAS, the City has determined that it will be mutually beneficial and in the public <br />interest to enter into a Grant Agreement with the Colorado Department of Public Safety, <br />Division of Homeland Security and Emergency Management in order to accept grant funding to <br />replace and upgrade the damaged County Road Bridge; and <br />WHEREAS, the City is authorized to enter into cooperative agreements or contracts <br />pursuant to the Colorado Constitution, Article XIV § 18, and § 29-1-203, C.R.S. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILLE, COLORADO: <br />1. The Colorado Department of Public Safety, Division of Homeland Security and <br />Emergency Management Grant Agreement (the "Agreement") for the Louisville County Road <br />Bridge Project, is hereby approved in essentially the same form as the copy of such Agreement <br />accompanying this Resolution. <br />2. The Mayor or Mayor Pro Tem are authorized to execute the Agreement on behalf of <br />the City, except that the Mayor or City Manager are hereby further granted authority to negotiate <br />and approve such revisions to said Agreement as the Mayor or City Manager determines are <br />necessary or desirable for the protection of the City, so long as the essential terms and conditions of <br />the Agreement are not altered. <br />3. The Mayor, Mayor Pro Tem, City Manager, City Clerk and City staff are hereby <br />authorized to execute all documents and do all other things necessary on behalf of the City to <br />effect the provisions of the Agreement and perform the obligations of the City under the <br />Agreement, including but not limited to execution and delivery of all certifications, reports, <br />forms, option letters, contract amendments and other documents appropriate or required in <br />connection with the Agreement and completion of the scope of work to be funded through the <br />Agreement. <br />Resolution No. 48, Series 2016 <br />Page 1 of 2 <br />
