CITY OF LOUISVILLE <br />BOARD OF ADJUSTMENT <br />STAFF REPORT <br />October 19, 2016 <br />APPLICANT: Greg Godec, 749 Wildrose Way <br />OWNER: Same <br />STAFF PLANNER: Scott Robinson, Planner II <br />LOCATION: 749 Wildrose Way, Lot 1, Centennial 4 Subdivision <br />ZONING: Residential Estate (RE) <br />REQUEST: Case #16 -027 -VA — Request for an after -the -fact variance from <br />Section 17.16.030 of the Louisville Municipal Code (LMC) for <br />relief from rear accessory setback to permit a previously <br />constructed pergola. <br />SUMMARY OF PROPOSAL: <br />The applicant, Greg Godec, requests an after -the -fact variance from the rear accessory <br />structure setback requirement to allow for the permitting of a previously constructed <br />pergola in the back yard at 749 Wildrose Way. The pergola posts sit 2.5 feet from the rear <br />lot line and the rafters extend to within one foot of the rear lot line. The required rear <br />accessory setback per section 17.16.030 of the LMC is 10 feet. This application was <br />continued from the September 21 Board of Adjustment meeting at the applicant's request. <br />An updated letter from the applicant addressing the criteria and a document from XCEL <br />Energy addressing trees near powerlines provided by the applicant are attached. Staff's <br />analysis and recommendation below are unchanged. <br />1 <br />
