5. That the variance, if granted, will not alter the essential character of the neighborhood or district the <br />in which the property is located, nor substantially or permanently impair the appropriate use or <br />development of adjacent property. <br />If this variance is granted it will not alter the character of the neighborhood and will enhance the view of <br />the corner from the street and trails adjacent to the property. This project will in no way impair the use <br />or development of the adjoining property. <br />6. That the variance, if granted, is the minimum variance that will afford relief and is the least <br />modification possible of the provisions of Title 17 of the Louisville Municipal Code that is in question. <br />Please see item three (3) above. The requested variance if granted is the minimum that will allow relief <br />from the hardship and to allow a seamless visual transition along the property line. Placing the trellis <br />and pergola any farther into the yard will create an awkward and unsightly gap between the street and <br />the property line. In addition there is a planter between this property and the road so the trellis and <br />Pergola are already over ten feet from the sidewalk in most cases and in the center section are almost <br />twenty feet from the corner. With an additional ten foot setback the structure would be an <br />unreasonable and unsightly distance from the corner. We have searched our hearts, spent a lot of time <br />driving and walking behind houses in Louisville and talked to dozens of neighbors that support the <br />current structure and believe that this is the best and right decision for the board to make and is in <br />compliance with the responsibility of the board to protect the character and aesthetic value of our <br />community. <br />
