APPROVAL OF BILLS <br />MCSTAIN ENTERPRISES, INC. - FINAL SUBDIVISION PLAT, PUD DEVELOPMENT <br /> PLAN, AND A SPECIAL REVIEW USE - CENTENNIAL H - ADOPTION OF FINDINGS <br /> OF FACT - REQUEST CONTINUANCE TO THE NOVEMBER 1, 1994, CITY COUNCIL <br /> MEETING <br />APPROVAL OF AN AMENDMENT TO A FINAL PUD DEVELOPMENT PLAN - <br /> EXPLOSIVE FABRICATORS - EFI LETTER REQUESTING CONTINUANCE TO <br /> NOVEMBER 1, 1994, COUNCIL MEETING <br /> APPROVAL OF ACQUISITION OF WINDY GAP WATER RIGHTS <br />PONDEROSA SUBDIVISION - MEMO FROM CITY ATTORNEY SUSAN GRIFFITHS - <br /> REQUEST FOR BUILDING PERMITS <br /> <br />PUBLIC COMMENTS - ON TIMES NOT ON THE AGENDA <br /> <br />John Mayhoffer, 1014 Empire Drive, Lafayette, Colorado, stated that there was an agreement <br />Louisville made with the developers of Bridgefield East that they were to meet with the owners of <br />the ditch right-of-way that went behind the property that they were developing at that time. They <br />approached Mayhoffer to sign a contract. Mayhoffer and the ditch owners did not agree with the <br />contract, since the city had requested that a bike path be place within 6" of the dirt ditch. He stated <br />that the sidewalk would not stay in there under heavy flows of water or the flows of water that they <br />have. He commented that two years ago the ditch overflowed into the city, which created a <br />confrontation. They would like to see the ditch put into a pipe for safety reasons. He stated that the <br />developer refuses to do anything about this at this time. They wanted Mayhoffer to get a contractor <br />to put the ditch in as they show it. When their engineer asked Mayhoffer to sign their original <br />contract, Mayhoffer took him to see the ditch. The engineer did not realize what kind of a situation <br />this was. He would not have suggested what is shown on their development PUD. <br /> <br />Paul Wood, Planning Director, had gotten Wonderland Homes in contact with Mr. Mayhoffer, but <br />they had not been able to agree on whether the ditch should be piped. Wood stated that he would <br />be working on a referral of ditch matter with the City Attorney in terms of what actions the city might <br />have over the subdivider in this case, since the open ditch was approved on the PUD. He will be <br />getting back with Mayhoffer as to the alternatives. <br /> <br />Susan Griffiths, City Attorney, stated that she and Paul Wood would be getting back with Council <br />with recommendations at the November 15, 1994, Council meeting. <br /> <br />COUNCIL INFORMATIONAL COMMENTS ON PERTINENT ITEMS <br /> NOT ON THE AGENDA <br /> <br />Mayer congratulated the Parks & Recreation Department on receiving a gold metal designating them <br />as being the premiere Parks & Recreation Department for cities under 20,000 in population. He <br />commented that this is the second award that one of the city's departments had gotten on a national <br />level in the last couple of years. <br /> <br />2 <br /> <br /> <br />
