If someone wanted <br />to come back at a later date, those things would also be <br />available. <br /> <br />Howard moved that according to senate bill 91-33 the Open Meetings - Designation of <br />public place or places for posting Notices of Public Meetings continue as it is with the <br />amendment of Councilwoman Hornbostel. <br /> <br />ADOPTION OF RESOLUTION NO. 6 TO RESCIND 1982 WATER AGREEMENT; <br />APPROVE NEW SEWER AGREEMENT AND RESCIND 1982 SEWER AGREEMENT; <br />AND DIRECT DISMISSAL OF PENDING LITIGATION; ALL IN CONNECTION WITH <br />TOWN OF SUPERIOR VS. CITY OF LOUISVILLE INVOLVING 1982 WATER AND <br />SEWER AGREEMENTS. <br /> <br />Griffiths: <br /> <br />Before you for consideration this evening is a resolution <br />which does several things each of which relates to <br />agreements between the City of Louisville and the Town <br />of Superior. The resolution first approves a one page <br />document that rescinds the 1982 water agreement with <br />the Town of Superior. The second portion of the <br />resolution adopts a new sewer agreement between the <br />City and the Town of Superior and as part of adopting <br />the new sewer agreement it rescinds the old sewer <br />agreement. The third thing the resolution does is direct <br />the City Attorney to take all action necessary or <br />appropriate to dismiss with prejudice each party to bear <br />its own cost and attorney's fees pending litigation <br />between the Town of Superior and the City of <br />Louisville. That litigation involves a dispute over the <br />validity of the 1982 water agreement and the 1982 sewer <br />agreement, the case is currently pending before the <br />Colorado Court of Appeals. The case would be <br />essentially rendered moot if the resolution were <br />approved rescinding the water agreement and rescinding <br />the 1982 sewer agreement since the lawsuit involves <br />solely on interpretation of those two agreements. The <br />City of Louisville is the first of the two communities to <br />potentially act on these matters. We want to be sure <br />that both parties act in the same fashion. Paragraph 4 <br />of the resolution states that the entire resolution and <br />the rescissions of the two agreements in the adoption of <br /> <br /> <br />
