Minutes from October 21, 2003 show this was passed - no signed copy exists: "Planning Director Paul Wood reviewed the City initiated an annexation by petition, to annex a 3.381-acre parcel in conjunction with S 96th/Highway 42 Road Construction Project. The annexation parcel is located west of S 96th Street and north of Dillon Road. The parcel is needed for right-of-way purposes for the construction of improvements to Dillon Road and S 96th Street. The land was formerly part of the Warembourg Open Space Property, which was held jointly between Boulder County and the City of Louisville. The warranty deed reflects conveyance of the property from the County to the City. An amendment of the Deed of Conservation Easement in Gross, has been executed and recorded which releases the right-of-way from the County to the City. MOTION: Sisk moved that Council approve Resolution No. 37, Series 2003, seconded by Levihn. All in favor. Brown and Keany absent"

Section 7. If the City Council concludes, by resolution, that all statutory requirements <br />have been met and that the proposed annexation is proper under the laws of the State of Colorado, <br />the City Council may pass one or more ordinances annexing the subject property to the City of <br />Louisville. <br />PASSED AND ADOPTED this 20 day of October 2003. <br />ATTEST: <br />Nancy Varra, City Clerk <br />2 <br />Tom Davidson, Mayor <br />
