offered an agreement to sign that
included the rebate, which they
didn't sign at that time. The
request was heard again in December
of 1991 and there was no discussion
at that time of the rebate
provision. From my perspective, the
Council is not bound to grant it or
deny it. Council can decide that
tonight. If Council decides to
grant it tonight, Council is not
legally bound to grant it to others
in the future. The City will not
become a public utility by providing
this service.

Mayer:

Davidson:

Does the City have a policy that
there's a double tap fee?

There is an Ordinance that requires
a double tap fee.

Lathrop:

What was the situation with the
three other neighbors as far as what
tap fee they paid?

Helms:

The three neighbors paid the double
tap fee at that time, which is
somewhat less than the fee now.

Lathrop:

Did they have a provision, that
you're aware of, of any kind of
reimbursement when they annex into
the City?

Helms:

Not that I'm aware of. Also, they
do not have an agreement signed by
them with the City.

Sisk:

Mr. Helms, were you led to believe
by the years previous agreement that
you would get one-half back?

Helms:

It was in the 1990 agreement which
we did not sign, because we wanted
to receive the water tap without
signing the agreement, as our
neighbors had.

Lathrop moved that the Water and Service Annexation Agreement
between Lanny and Martha Helms and the City of Louisville, as
presented, be accepted without the reimbursement.
