unable to pay bonded indebtedness <br />outside of revenue bonds, then the <br />Statutes would allow us charge an <br />additional 1/2 mill on the <br />properties to cover that <br />indebtedness. We're governed by a <br />Board of 12 Directors. The <br />principal counties that we deliver <br />water directly to are Boulder, <br />Larimer, and Weld Counties. There <br />are three Directors from each of <br />those Counties. There is another <br />Director from (each) the lower South <br />Platt River, Logan, Washington, <br />Segwick and Morgan Counties. They <br />are appointed by the presiding <br />District Judge. There is a <br />provision in the Statutes, whereby <br />if a Director's constituency doesn't <br />believe he's adequately representing <br />them, he can be recalled and <br />replaced with an election. The <br />subdistrict also has the authority <br />to levy taxes for the purpose of <br />retiring revenue bonds. The <br />District has the same authority in <br />addition to the one mill ad valorem <br />tax, it can issue a tax to repay <br />debt that is in default from revenue <br />bonds in accordance with the State <br />Constitution, which allows general <br />obligation tax for water <br />infrastructure. We deliver water <br />supplies directly to use primarily <br />in Boulder, Larimer, and Weld <br />Counties. The District boundaries <br />extend east of Weld County into <br />Morgan, Sedgewick, Logan, and <br />Washington Counties. They pay that <br />one mill tax and get no delivery of <br />CBT water, because of the value <br />that's received from the return <br />flows from CBT. Both CBT and Windy <br />Gap waters are trans-mountain <br />supplies. Under the laws of <br />Colorado, Trans-mountain supplies <br />can be reused to extinction. In the <br />case of CBT water, the Board's <br />policies prevent the reuse of CBT. <br />A municipality or a farmer is only <br />entitled to one use of CBT with the <br />return flows dedicated back to the <br /> <br />5 <br /> <br /> <br />
